{"id":21377,"date":"2022-02-04T10:17:30","date_gmt":"2022-02-04T15:17:30","guid":{"rendered":"https:\/\/www.rsslex.com\/?p=21377"},"modified":"2022-02-14T16:04:02","modified_gmt":"2022-02-14T21:04:02","slug":"autorisations-a-portee-collective-et-allegement-a-la-construction-residentielle","status":"publish","type":"post","link":"https:\/\/www.staging.rsslex.com\/en\/bulletins-en\/autorisations-a-portee-collective-et-allegement-a-la-construction-residentielle\/","title":{"rendered":"Autorisations \u00e0 port\u00e9e collective et all\u00e8gement \u00e0 la construction r\u00e9sidentielle"},"content":{"rendered":"<p><strong>Only available in French<\/strong><\/p>\n<p>Depuis 2001, les M.R.C. peuvent requ\u00e9rir de la Commission de protection du territoire agricole du Qu\u00e9bec (\u00ab\u00a0CPTAQ\u00a0\u00bb) qu\u2019elle d\u00e9termine dans quels cas et \u00e0 quelles conditions la nouvelle utilisation \u00e0 des fins r\u00e9sidentielles pourrait \u00eatre implant\u00e9e en zone agricole.<\/p>\n<p>Plusieurs M.R.C. ont obtenu de telles autorisations \u00e0 port\u00e9e collective. Cependant, les autorisations \u00e9taient conditionnelles \u00e0 ce que les M.R.C. et, par la suite, les municipalit\u00e9s locales concern\u00e9es modifient leur r\u00e9glementation en mati\u00e8re d\u2019urbanisme pour introduire les conditions impos\u00e9es par la CPTAQ.<\/p>\n<p>Parmi les conditions qu\u2019on y retrouvait, il y avait certaines limitations \u00e0 l\u2019\u00e9rection de r\u00e9sidences en zone agricole. L\u2019une d\u2019elles pr\u00e9voyait qu\u2019\u00e0 l\u2019\u00e9gard des superficies b\u00e9n\u00e9ficiant d\u2019un droit acquis d\u00e9coulant des articles 101 \u00e0 103 de la <em>Loi sur la protection du territoire et des activit\u00e9s agricoles<\/em> (\u00ab\u00a0LPTAA\u00a0\u00bb), seule la reconstruction d\u2019une r\u00e9sidence \u00e9tait autoris\u00e9e.<\/p>\n<p>Cette condition, ajout\u00e9e aux r\u00e8glements d\u2019urbanisme de la municipalit\u00e9, rendait donc impossible la construction d\u2019une seconde r\u00e9sidence sur une superficie b\u00e9n\u00e9ficiant d\u2019un droit acquis, m\u00eame si la superficie du terrain \u00e9tait suffisante, et ce, m\u00eame si les tribunaux avaient \u00e9tabli un tel droit dans l\u2019affaire Boerboom<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>. De ce fait, une seconde r\u00e9sidence ne pouvait g\u00e9n\u00e9ralement pas \u00eatre \u00e9rig\u00e9e sur une superficie de terrain prot\u00e9g\u00e9e par des droits acquis sans requ\u00e9rir une nouvelle autorisation de la CPTAQ.<\/p>\n<p>La CPTAQ a revu sa position le 20 juin dernier. Par communiqu\u00e9, la CPTAQ informe la population \u00ab\u00a0<strong><em>qu\u2019\u00e0 compter de ce jour, la \u00ab\u00a0condition Boerboom\u00a0\u00bb est r\u00e9put\u00e9e non \u00e9crite dans toutes les d\u00e9cisions favorables o\u00f9 elle se trouve et qui n\u2019ont pas encore \u00e9t\u00e9 remplac\u00e9es<\/em><\/strong>.\u00a0\u00bb<\/p>\n<p>Ce renversement de situation de la CPTAQ a pour effet d\u2019annuler les conditions dans la d\u00e9cision de port\u00e9e collective exig\u00e9e de la CPTAQ, tant pour le pass\u00e9 que pour le futur.<\/p>\n<p>Cependant, les r\u00e8glements en mati\u00e8re d\u2019urbanisme qui continuent \u00e0 pr\u00e9voir une telle restriction dans le cas o\u00f9 elle s\u2019applique ne sont pas modifi\u00e9s pour autant et continuent de s\u2019appliquer.<\/p>\n<p>Cependant, les municipalit\u00e9s peuvent maintenant modifier leur r\u00e8glementation municipale \u00e0 cet effet. En pratique, comme ce sont les M.R.C. qui avaient obtenu les autorisations \u00e0 port\u00e9e collective, elles ont g\u00e9n\u00e9ralement ins\u00e9r\u00e9 les limitations impos\u00e9es par les autorit\u00e9s dans leur sch\u00e9ma d\u2019am\u00e9nagement ou dans un r\u00e8glement de contr\u00f4le int\u00e9rimaire. Ce sont donc \u00e0 elles d\u2019initier les all\u00e9gements \u00e0 la r\u00e9glementation pour modifier leur sch\u00e9ma d\u2019am\u00e9nagement et\/ou leur r\u00e8glement de contr\u00f4le int\u00e9rimaire pour ensuite permettre aux municipalit\u00e9s locales qui le d\u00e9sirent d\u2019apporter les ajustements \u00e0 leur r\u00e8glement d\u2019urbanisme.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> \u00a0\u00a0\u00a0 <em>Boerboom c.
