Too often, however, we forget that this article imposes a similar obligation upon an employee who resigns without a serious reason.<\/p>\n<p>A recent decision reminds that \u201cthe legal obligation to give notice applies to the resigning employee as it does to the employer who terminates the employee\u201d [<i>Pharmacie Jean-S\u00e9bastien Blais inc. c. Pharmacie \u00c9ric Bergeron et Andr\u00e9 Vincent inc.<\/i>, <a href=\"https:\/\/canlii.ca\/t\/gp0kj#par54\" target=\"_blank\" rel=\"noopener\">2016 QCCS 1306<\/a>, par. 54; our translations].<\/p>\n<p>According to the Court, \u201cthe notice is meant to give the employer enough time to hire and train someone to replace the employee who resigns, or to adapt his operations to the absence of the employee\u201d [par. 55].<\/p>\n<p>Failure to give reasonable notice can cause the employer damages that the employee could have to compensate. In such a case, the employer has a right to damages calculated \u201cin light of all the facts, the duration of the employment, the employee\u2019s importance in the business operations, his salary and work conditions, and the circumstances of his departure\u201d [par. 73].<\/p>\n<p>In this case, the employee was condemned to pay his former employer compensation for $12,000, representing two months\u2019 salary.<\/p>\n<h2>A few examples<\/h2>\n<p>For reasons that are easy to guess, resigning employees are rarely sued and held to pay damages for failure to give reasonable notice. Still, case law does provide some examples of awards payable to ex-employers:<\/p>\n<ul>\n<li>$28,193, corresponding to six weeks\u2019 salary (<i>Traffic Tech inc. c. Kennell<\/i>, <a href=\"https:\/\/canlii.ca\/t\/gn5w7\" target=\"_blank\" rel=\"noopener\">2016 QCCS 355<\/a>, a decision that we <a href=\"https:\/\/www.staging.rsslex.com\/publications\/pensez-au-renouvellement-de-vos-contrats-demploi-a-lecheance\/\">already commented<\/a> on another aspect)\n<li>$4,000, set under the Court\u2019s discretionary power (<i>Environnement Sanivac inc. c. Lamoureux<\/i>, <a href=\"https:\/\/canlii.ca\/t\/glx5g\" target=\"_blank\" rel=\"noopener\">2015 QCCQ 10261<\/a>)\n<li>$1,564, corresponding to two weeks\u2019 salary  (<i>Distribution Charlebois inc. c. Leroux<\/i>, <a href=\"https:\/\/canlii.ca\/t\/gl1lg\" target=\"_blank\" rel=\"noopener\">2015 QCCQ 7341<\/a>)\n<li>$5,292, corresponding to three weeks\u2019 salary, on top of $2,500 for general damages and intentional destruction of computer files by the ex-employee (<i>Ethica Clinical Research Inc. c. Le Gall<\/i>, <a href=\"https:\/\/canlii.ca\/t\/gj468\" target=\"_blank\" rel=\"noopener\">2015 QCCQ 3708<\/a>)\n<li>$1,180, for salaries and expenditures paid by the ex-employer (<i>9142-2097 Qu\u00e9bec inc. c. C\u00f4t\u00e9<\/i>, <a href=\"https:\/\/canlii.ca\/t\/fnmj5\" target=\"_blank\" rel=\"noopener\">2011 QCCQ 12635<\/a>)\n<li>$4,000, for lost income (<i>Transport Daniel Baril A. inc. c. Valade<\/i>, <a href=\"https:\/\/canlii.ca\/t\/flzdb\" target=\"_blank\" rel=\"noopener\">2011 QCCQ 6792<\/a>))\n<li>$14,814, payable by three ex-employees to compensate income lost by the ex-employer (<i>Vibration et balancement Borgia (3436993 Canada inc.) c. Richard<\/i>, <a href=\"https:\/\/canlii.ca\/t\/fl951\" target=\"_blank\" rel=\"noopener\">2011 QCCQ 3989<\/a>))\n<li>$15,000, set under the Court\u2019s discretionary power (<i>Carrefour immobilier de l\u2019Estrie inc. (Groupe Sutton de l\u2019Estrie) c. Gagnon<\/i>, <a href=\"https:\/\/canlii.ca\/t\/1t4vv\" target=\"_blank\" rel=\"noopener\">2007 QCCS 4471<\/a>))\n<li>$7,500, corresponding to six weeks\u2019 salary and including $1,000 in general damages (<i>Corporation Tribospec c. Spartan Marketing Services Inc.<\/i>, <a href=\"https:\/\/canlii.ca\/t\/1nq84\" target=\"_blank\" rel=\"noopener\">2006 QCCQ 5840<\/a>).\n<\/ul>\n<h2>What lessons can we draw from these examples?<\/h2>\n<p><b>If you are an employee<\/b>: announce your resignation early enough to give your employer enough time to plan for your replacement. Keep in mind that the Civil Code imposes an obligation of loyalty that persists even after your departure&nbsp;&mdash; in addition to eventual non-competition clauses that could still be binding. Ideally, discuss your intention with your employer and come to an agreement on the conditions of your departure.<\/p>\n<p><b>If you are an employer<\/b>: remind your employees of their obligation to give a notice of resignation, by specifying a clause in the letter of employment or the collective agreement.
